Proposals and Binding Coverage
Insurance coverage cannot be bound or changed via submission of an online form, email, voicemail, or facsimile. No binder, policy, change, addition, or deletion to coverage goes into effect unless and until confirmed directly with a licensed agent.
Any proposal we present will be based upon the values and exposures disclosed to us through your application and communications with us. All coverages are subject to the terms, conditions, and exclusions of the actual policy issued. Not all coverages are available in every state. Information submitted to us is used solely for insurance purposes and is not distributed to unrelated third parties.
Media and Editorial
Falcon West publishes educational content through our website and the Falcon Forward podcast. All content — including articles, podcast episodes, and other media — is for educational and informational purposes only and does not constitute specific insurance, financial, or legal advice. We encourage you to conduct your own research and consult with qualified professionals regarding your specific needs. Our published articles are reviewed quarterly for accuracy.
Content published through our media channels expresses the views of Falcon West Insurance Brokers, Inc. as of the date indicated and is subject to change without notice. Past insurance market conditions, coverage terms, or pricing discussed in our content are not indicative of future results. Applications, Forms, and Client Portal
By submitting any application or form with Falcon West on falconwest.com, app.falconwest.com, or falconwestenergy.com, you consent to Falcon West Insurance Brokers, Inc. saving the information you enter and sharing it with insurance carriers and other insurance professionals in order to obtain quotes and bind coverage on your behalf.
We also provide a secure client portal for you to upload documents directly to us. Documents submitted through the portal are received, stored securely, and used solely for insurance underwriting and servicing purposes.
Application data and uploaded documents are stored in our WordPress/GravityForms system and manually reviewed and deleted within 30 days, after which the information is retained in our agency management system (AMS) for the period required by California Department of Insurance regulations. See the “How Long We Keep Your Information” section for full details.
Information We Collect
The information we collect depends on the type of insurance coverage you are requesting. In all cases, we collect only what is required by insurance carriers for underwriting and quoting purposes. We do not collect information beyond what is necessary to serve you.
Personal Lines Insurance
When you apply for personal insurance coverage — including homeowners, auto, umbrella, or personal articles — we collect the personal, property, vehicle, and claims information required by insurance carriers to evaluate your risk and generate an accurate quote. This includes contact and identity information for all household members, details about the property or vehicles to be insured, prior claims history, and any other information required for underwriting.
Where required for rating or underwriting, this may include sensitive identifiers such as dates of birth and driver’s license numbers for licensed drivers in your household. This information is shared only with insurance carriers and markets as required to obtain a quote or bind coverage.
You may also upload supporting documents through our client portal, including current policy documents, loss runs, photos of property or vehicles, and personal identification documents. Uploaded documents are used solely for underwriting and coverage placement purposes.
Driver’s license numbers and personal identification documents are sensitive identifiers under California law and the Gramm-Leach-Bliley Act (GLBA). They are collected solely because carriers require them for underwriting, are shared only with those carriers, and are never used for any other purpose.
Commercial Lines Insurance
When you apply for business insurance coverage — including general liability, commercial property, business auto, workers’ compensation, errors and omissions (E&O), or other commercial lines — we collect the business, financial, operational, and claims information required by insurance carriers to evaluate your risk and generate an accurate quote. This includes business identity and contact information, financial data, leadership and workforce details, property information, vehicle and driver schedules, prior claims history, and any other information required for underwriting.
All commercial submissions require a Federal Employer Identification Number (FEIN), which is shared with carriers solely for underwriting purposes.
You may also upload supporting documents through our client portal, including loss runs, current policy documents, photos of business property or vehicles, and personal identification documents for owners or key personnel. Uploaded documents are used solely for underwriting and coverage placement purposes.
FEIN and personal identification documents are treated as sensitive financial and personal information under GLBA and California law. They are shared only with insurance carriers and markets for underwriting purposes and are never used for any other purpose.
Website Usage Information
When you visit our website, Fathom Analytics collects anonymous, aggregate traffic data — such as page views and referral sources — that cannot be linked to any individual. No personal data is collected through our analytics platform and no cookies are set by Fathom.
Cookies and Tracking
We do not track our users. We do not use advertising cookies, retargeting pixels, or any third-party tracking technology.
Our website uses GravityForms to power our insurance application and intake forms. GravityForms sets a temporary session cookie solely to preserve your progress if you navigate away from a form before completing it. This cookie contains no personal information, is not used for tracking or advertising, and expires automatically when your browser session ends.
If a payment is processed through our website, our payment processor (ePay Policy) may set a short-lived session cookie to facilitate the secure transaction. This cookie expires upon completion of the payment session.
Fathom Analytics, our website analytics provider, is cookieless by design and collects no personally identifiable information.
No other cookies are set by our website for regular visitors.
How We Use Your Information
We use the information you provide to:
- Obtain and manage insurance quotes and policies on your behalf
- Communicate with you about your coverage, renewals, claims, and service requests
- Send educational newsletters and industry updates (you may opt out at any time)
- Process payments for services
- Review uploaded documents for underwriting and coverage placement purposes

We do not use your information for advertising, behavioral profiling, or sale to third parties.
Who We Share Your Information With
We share your information only as necessary to serve you:
- Insurance carriers and wholesale markets — to obtain quotes and bind coverage on your behalf
- Kit — our email platform, used to manage newsletters and service communications
- ePay Policy — our payment processor, used to securely handle transactions
- GravityForms / WordPress — our form and portal platform, used to receive and temporarily store applications and uploaded documents
- Our agency management system (AMS) — where application data and documents are transferred for long-term retention in compliance with regulatory requirements
- Legal or regulatory authorities — when required by law or in response to a valid legal request
We do not sell your personal information. We do not share it with advertisers, data brokers, or any party unrelated to your insurance needs.
Federal Financial Privacy (GLBA)
As a licensed insurance broker, Falcon West is subject to the Gramm-Leach-Bliley Act (GLBA), which requires us to protect the nonpublic financial and personal information you share with us. This includes information such as income, payroll, revenue, FEIN, mortgage details, driver’s license numbers, personal identification documents, and insurance policy data.
We maintain physical, electronic, and procedural safeguards to protect your nonpublic personal information. This includes secure transmission of uploaded documents, restricted access controls on our web platform and agency management system, and limitations on who within Falcon West can access sensitive data. We do not share your nonpublic personal information with nonaffiliated third parties for marketing purposes.
How Long We Keep Your Information
Web Platform — Up to 30 Days
Application data entered through our website forms and documents uploaded through our client portal are stored in our WordPress/GravityForms system. Our team manually reviews and deletes this data within 30 days. Prior to deletion, the information is transferred to our agency management system.
Agency Management System — Long-Term
Application data and uploaded documents transferred to our agency management system (AMS) are retained for the period required by California Department of Insurance regulations and applicable federal law. Insurance records are generally retained for a minimum of five years following the expiration or termination of a policy.
Anonymous website analytics data collected by Fathom is not tied to any individual and is not subject to a personal data retention schedule.
Security
We use commercially reasonable physical, electronic, and administrative safeguards to protect your personal information, including:
- Secure (HTTPS) transmission for all data entered through our website forms and client portal
- Access controls limiting which Falcon West personnel can view sensitive application data and uploaded documents
- Manual review and deletion of web platform data within 30 days of submission
- PCI-DSS compliant payment processing — we never store payment card details
No method of transmission over the internet is 100% secure. We will notify you of a data breach as required by California law.
Your Privacy Rights (California Residents)
Under the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA), you have the right to:
- Know what personal information we have collected about you and why
- Access a copy of the personal information we hold about you
- Request correction of inaccurate personal information
- Request deletion of your personal information, subject to legal retention requirements
- Opt out of the sale or sharing of your personal information — we do not sell or share personal information for advertising purposes
- Not be discriminated against for exercising any of these rights

You may also designate an authorized representative registered with the California Secretary of State to submit requests on your behalf.

The following reflects our good-faith disclosure of personal information categories collected within the last 12 months. Some categories apply only to personal lines applicants, some only to commercial applicants, and some to both.

Sale of Personal Information
We do not sell personal information as that term is commonly understood. The only personal information we share with third parties is what is necessary to obtain insurance quotes and bind coverage on your behalf — specifically Category A (identifiers) and Category B (California Customer Records). We receive no monetary or equivalent benefit from such sharing beyond the services rendered to you.
California Shine the Light
Under California Civil Code Section 1798, California residents with an established business relationship with us may request information once a year about sharing their personal data with third parties for direct marketing purposes. We do not share personal data for third-party direct marketing purposes.
Privacy Rights for EU Residents (GDPR)
If you are located in the European Economic Area, you have additional rights under the General Data Protection Regulation (GDPR), including the right to access, correct, delete, or restrict processing of your personal data, and the right to data portability. Our legal basis for processing your data is typically performance of a contract or compliance with a legal obligation.

Children’s Privacy
Our Service is not directed to anyone under the age of 13. We do not knowingly collect personal information from children under 13. If you believe a child has submitted personal information to us, please contact us immediately and we will remove it promptly.
